Safe Driving Disclaimer
Last Updated: September 9, 2026⚠ IMPORTANT: Never interact with the DashCam MVP app while operating a moving vehicle. Always pull over safely before adjusting settings, reviewing footage, or using any app controls. Your safety and the safety of others on the road is your sole responsibility.
1. Purpose of This Disclaimer
ShinyNew Technologies LLC ("ShinyNew," "we," "our," or "us") provides the DashCam MVP application and related services to help drivers document their journeys and improve their safety and accountability on the road. While we are committed to designing intuitive, minimally intrusive tools, we recognize that any application used in or near a moving vehicle carries the potential for distraction. This disclaimer sets out your responsibilities and our limitations of liability with respect to safe vehicle operation.
2. No Distraction While Driving
DashCam MVP is designed to operate passively in the background. However, you expressly acknowledge and agree that:
- You must not interact with, adjust, or operate DashCam MVP while driving a moving vehicle. This includes, but is not limited to, tapping the screen, reviewing footage, changing settings, activating features, or reading notifications generated by the app.
- All configuration of the app — including recording settings, storage preferences, and alert customizations — should be completed before beginning to drive or only after bringing your vehicle to a complete, safe stop in a lawful location.
- Audio and visual alerts generated by DashCam MVP should be configured to a level that does not cause you to divert attention from the road.
- Mounting your dashcam device in a position that obstructs your field of vision is dangerous and may be illegal. ShinyNew does not provide hardware installation services and is not responsible for improper device mounting.
3. User Responsibility for Safe Vehicle Operation
You, as the operator of the vehicle, are solely and exclusively responsible for:
- Operating your vehicle safely and in full compliance with all applicable traffic laws, regulations, and ordinances in your jurisdiction.
- Maintaining full attention on the road, surrounding traffic, pedestrians, and road conditions at all times while your vehicle is in motion.
- Ensuring that the use of DashCam MVP — or any connected device — does not impair your ability to safely control your vehicle.
- Complying with all laws regarding handheld device use, distracted driving, and dashcam recording consent in your state, country, or territory.
- Taking all necessary precautions to ensure that passengers, especially minors, do not interact with the app in a way that could distract the driver.
No feature, notification, or functionality of DashCam MVP excuses or overrides your obligation to operate your vehicle safely at all times.
4. Limitation of Liability for Misuse
SHINYNEW TECHNOLOGIES LLC IS NOT LIABLE — DIRECTLY OR INDIRECTLY — FOR ANY ACCIDENTS, INJURIES, PROPERTY DAMAGE, TRAFFIC VIOLATIONS, LEGAL PENALTIES, OR ANY OTHER HARM ARISING FROM:
- Your use of DashCam MVP while operating a moving vehicle;
- Distraction caused by the app's interface, alerts, or notifications while driving;
- Improper mounting, installation, or positioning of a dashcam device;
- Failure to comply with applicable traffic or recording consent laws in your jurisdiction;
- Any other misuse of the DashCam MVP application or its features.
By using DashCam MVP, you expressly agree that ShinyNew Technologies LLC, its officers, directors, employees, agents, and licensors bear no responsibility whatsoever for damages — including personal injury, death, vehicle damage, third-party claims, or legal consequences — resulting from your decision to interact with the Service while driving or from any other unsafe use of the Service.
5. Compliance with Local Laws
Dashcam recording laws, privacy requirements, and distracted driving regulations vary significantly by state and country. It is your responsibility to understand and comply with all laws applicable to your use of DashCam MVP in your location. ShinyNew makes no representations that the Service is appropriate or lawful for use in all jurisdictions.
6. Emergency Situations
In the event of an emergency while driving, do not attempt to access DashCam MVP. Pull over safely and call emergency services (911 in the United States) as your first priority. DashCam MVP is not an emergency response service and cannot replace calling emergency services.
